A suspended seventh-grade student in Virginia Beach, Va., could be expelled for the rest of the school year for shooting an airsoft gun with a friend in his yard as they waited for the bus to come.

airsoft guns, WAVY-TV reported.

Caraballo answered “no, sir,” when asked if he took the toy gun to the bus stop or to school.

“We were in our yard. This had nothing to do with school,” the student said.

Caraballo’s mother, Angel, said being punished for “possession, handling and use of a firearm” was “pretty harsh” for a toy that she bought for $25.

Tim Clark, Aidan’s father, told the news station that the school neglected to use common sense in the incident that occurred off school property.

FBI: NO INDICATION AR-15 WAS USED IN NAVY YARD SHOOTING

The FBI said there is no indication that an AR-15 was used in the shooting rampage at the Washington Navy Yard, despite wide initial reports that gunman Aaron Alexis was armed with one when he murdered 12 people Monday.17navy_alexis-articleInline

“At this time we believe that Mr. Alexis entered Building 197 at the Navy Yard with a shotgun. We do not have any information at this time that he had an AR-15 in his possession,” Valerie Parlave, assistant director in charge of the FBI’s Washington field office, said at a news conference Tuesday. Officials said Alexis also took at least one handgun from a law officer.

The FBI’s confirmation came after CNN reported Tuesday morning that the initial reports that the shooter used an AR-15 may have been incorrect:

[F]ederal law enforcement sources told CNN Tuesday that authorities have recovered three weapons from the scene of the mass shooting, including one — a shotgun — that investigators believe Alexis brought in to the compound. The other two weapons, which sources say were handguns, may have been taken from guards at the Navy complex.

The sources, who have detailed knowledge of the investigation, cautioned that initial information that an AR-15 was used in the shootings may have been incorrect. It is believed that Alexis had rented an AR-15, but returned it before Monday morning’s shootings. Authorities are still investigating precisely how many weapons Alexis had access to and when.

The New York Daily News devoted its front page Tuesday to the supposed use of an AR-15, with the blaring headline “Same Gun Different Slay”:

Calls for bans on AR-15s skyrocketed after the mass slayings at Sandy Hook Elementary in Connecticut and an Aurora, Colo. movie theater last year. A new ban on “assault weapons” proposed by Sen. Dianne Feinstein (D-Calif.) specifically named AR-15-style rifles but was never brought up for a vote.

WIFE NEVER WANTED TO HAVE A GUN IN THE HOUSE

Texas man’s pregnant wife never wanted to have a gun in the house – but now she’s sure glad he insisted.

A Texas man’s pregnant wife made it clear she was against having a firearm in their house. However, the husband insisted she learn how to use a gun to protect herself just in case. In fact, it was just a few months ago that he took her out to teach her the basics.

On Saturday, she was extremely thankful to have the protection of a gun on her side.

The pregnant woman, identified only as “Alex,” told KGBT-TV that she was startled by the sound of a man banging loudly on her front door while another man walked around to the back of her Palmview, Texas, home. Her husband had just left 20 minutes before.FirefoxScreenSnapz034-620x339

“I’m a young woman, I’m pregnant, I’m home alone. I’m not going to answer the door – I mean, I know better,” she recalled.

Sensing something was very wrong, the pregnant woman retrieved her husband’s handgun for protection. With one hand on the firearm and the other dialing 911, one of the men broke into the house.

“Oh my gosh, he broke in!” the woman told the operator.

She remembered what her husband told her while practicing shooting just months before: “When you’re in a situation like that- you’re not going to think twice.”

He was right.

When the two men realized the woman was armed, they took off towards their truck. Alex’s “adrenaline kicked in” and she shot once at the vehicle. She said she was not aiming to shoot the men, but rather at the truck to both scare the burglars and provide police an identifying marker that might help them track it down.

Unsurprisingly, Alex is very thankful her husband insisted that they not only keep a firearm in the house, but that she learn how to use it.

“I was against him buying a gun maybe 7-8 months ago, but I told him, ‘I don’t know if I told you, thank you for doing that’ because it changed the situation completely,” she told KGBT-TV.

Palmview Police and SWAT eventually tracked down the suspects, brothers Lucas and Jesus Ortiz, who had barricaded themselves inside a different home. Authorities blocked off the area and negotiated with the two men, ultimately arresting them.

“Palmview Police say Lucas and Jesus Ortiz were high on unknown drugs at the time of the burglary and that they are still not being cooperative with the investigation,” KGBT-TV reports.

These are the carjackers who made a deadly mistake of targeting a driver with concealed carry permit

All the guy wanted to do was return his Redbox movie.

So he headed to a McDonald’s parking lot to drop off the DVD at a kiosk outside the fast-food restaurant…when two men armed with guns approached him and demanded his car keys and cell phone, according to Houston police.

The would-be thieves, however, had no idea their would-be carjacking victim had a concealed handgun license.

And as TheBlaze previously reported, the 29-year-old was carrying. KHOU-TV reports the man was forced out of his vehicle and pushed down.

Now we know about Melvin Auston and Elijah Mims, the alleged robbers the man shot as they tried to get in his car and drive away, reports KBTX-TV.

Auston, 26, died at the scene. Mims, 32, was injured but got away on foot. A third suspect reportedly picked up Mims and drove him 100 miles to a hospital, KBTX says, where he was treated for a gunshot wound and eventually arrested.

Mims has been charged with aggravated robbery with a deadly weapon. He and Auston boast extensive criminal histories, including violent offenses, KBTX reports.

A grand jury, KBTX says, will decide if the shooter will face charges.

A news report from KHOU indicates that the carjackers may have been interested in the “unusual” rims on the victim’s car wheels, which stick out about a foot — and that a “fake gun” may have been part of the incident:

I often get the question: “Can a CDL truck driver legally carry a gun in the truck?”

Legal disclaimer. I am not an attorney and I am not providing legal advice.  However, I do posses reading and comprehension skills and the laws of our nation are written so anyone can read and understand them.  If you are unsure of this article, please do your own research.

After an exhausted search, I only found one federal law regarding Interstate Transportation of a Firearm. I assume this is what has perpetuated the myth that CDL drivers can not carry. Nothing in this law would prevent a CDL drive, or any other person legally able to posses a firearm, from carrying a firearm in the method described in the law.  Unloaded, encased and not readily accessible.

My research show that CDL guidelines are issued by the Federal government to ensure uniformity across all states, however, the actual CDL is issued by the states themselves.  The state of issue may enact their own laws or guideline for a CDL that are more restrictive then the federal guidelines but never less.  Since each state has its own laws regarding firearms in vehicles, it would default to those laws for everyone.  I would point out that the discussion applies to anyone able to legally posses a firearm and not just a driver with a CDL.  Nothing I could find could reference any law stating otherwise or limited those with a CDL. However, an employer or owner of a truck does have the right to forbid firearms via policy.

A fundamental part of the legal system in our nation forbids a law from every trumping a right. The Bill of Right ensures you have the ability to bear arms and it would likely be unconstitutional for the federal government or state to remove that right because someone possessed a CDL.

In summary, the Feral laws states you can carry in all states if you firearm is unloaded, encased and not readily accessible.  However, each state has it’s own laws regarding possession of a firearm in a vehicle and a person traveling through that state would be subject to those laws. A state may have a different laws for those that possess a Concealed Firearm Permit versus those without.  Utah does not distinguish between the two and anyone can carry a handgun either loaded or unloaded (inside the vehicle and those legally able to posses a firearm).

Notwithstanding any other provision of any law or any rule or regulation of a State or any political subdivision thereof, any person who is not otherwise prohibited by this chapter from transporting, shipping, or receiving a firearm shall be entitled to transport a firearm for any lawful purpose from any place where he may lawfully possess and carry such firearm to any other place where he may lawfully possess and carry such firearm if, during such transportation the firearm is unloaded, and neither the firearm nor any ammunition being transported is readily accessible or is directly accessible from the passenger compartment of such transporting vehicle: Provided, That in the case of a vehicle without a compartment separate from the driver’s compartment the firearm or ammunition shall be contained in a locked container other than the glove compartment or console.

TEXAS TEEN PROTECTS GRANDMA’S PROPERTY

A Texas teen is being praised by neighbors for protecting his grandmother’s home from a burglary attempt early Wednesday morning after he shot and killed one of two suspects.

The break-in occurred in Baytown just after 5:30 a.m. when the 18-year-old told police he heard someone coming into the home. He called 911, grabbed a shotgun and found the two men in the living room, according to KHOU-TV.

When the two suspects did not put their hands up as the teen ordered, he shot at both. KHOU reported that one of the suspects, later identified as 40-year-old Charles Allen Dixon, died on site, while the other was wounded and ran away.

The second suspect, 26-year-old Michael McDaniel, showed up at a local hospital later for treatment. The women who drove him to the hospital are being questioned by police as well.

“He was in fear of his life, that’s the main thing,” Baytown Police Department Det. Edgar Elizondo told KHOU. “Situations like this we will see more often. More Texans arm themselves and we have a right to protect our property.”

Neighbors too say they think the young adult did the right thing.

“He did good, he did right, he did his job,” said Abe Garcia, according to the local news outlet.

KHOU reported that the teen, who had participated in a program for kids interested in the police force when he was younger, was living at his grandmother’s house after she was put into a nursing home. He is not facing any charges.

“They probably were thinking they were coming into an empty house, which they weren’t. The grandson was there,” neighbor Barbara Carr told KTRK-TV of the incident, noting that the same home had recently been broken into.

ROBBER BRINGS KNIFE TO PIZZA-DELIVERY HEIST

A pizza delivery-man fatally shot a knife wielding robber after dropping off a pizza to a motel room.

Domino’s employee Bryon Park, 54, had just returned to his vehicle after delivering a pizza to a room in a Days Inn motel in West Melbourne, Fla., about midnight Friday when Fredrick Lorenza Kelly Jr., 32, approached him with a large knife, the Brevard Times reports.

Kelly allegedly threatened to kill Park if he didn’t hand over money. A police official reports Park grabbed a gun he carries in his vehicle and fired once toward Kelly, who was later pronounced dead at the scene, the Times reports.

“Preliminary evidence in the case demonstrates that the intended victim of the robbery acted in self-defense while being robbed by a violent criminal who was armed with a knife,” Brevard County Sheriff Wayne Ivey said.

Kelly’s lengthy rap sheet includes armed robbery, aggravated battery, and false imprisonment, according to the sheriff’s office, and was released from prison in 2009, the Times says.

“Here’s how it works: before the seller runs your name in the system, you have to fill out a form testifying you’re legally allowed to purchase a firearm. Lying on that form is a federal felony,” begins Raso.

So let’s say that’s what happens — the criminal lies on the form and the seller takes it to the back to run the name through the system. In 2010, that scenario played out 76,000 times … and only 13 of those 76,000 were legally blocked from buying a firearm and were actually prosecuted and convicted for committing a felony in order to TRY to buy a firearm,” he continues.

“The Attorney General Eric Holder was asked about this statistic, and he said there isn’t enough time to catch and prosecute all these criminals,” said Raso.

“OK, fine. Law enforcement is stretched thin and they’ve got a lot of problems on their hands already. But don’t tell me that that situation is going to get better if we have a ‘universal’ background check system.”

STUDENT RANDOMLY SHOT DEAD JUST ‘FOR THE FUN OF IT’, POLICE SAY

Police say an Australian student visiting the U.S. on a baseball scholarship was randomly shot dead on Friday by a group of three teenagers who later confessed to authorities they killed him “for the fun of it.”

Chris Lane, 23, was jogging in a small Oklahoma town Friday night after visiting his girlfriend of four years when a gang of teenagers mercilessly gunned him down and left him to die.

According to Sky News, witnesses saw Lane stumble across the road and collapse in the gutter. A woman attempted CPR and paramedics rushed on the scene, but the Australian student was never taken to the hospital — he was pronounced dead at the scene.

One of the three teenage culprits, all arrested later, reportedly told police him and his friends had committed the heinous act “for the fun of it.”

Police described the tragic incident in greater detail.

“He went by a residence where these three boys were, they picked him as a target, they went out and got in a vehicle and followed him,” Chief of Duncan Police Danny Ford reportedly said.

“[They] came up from behind and basically shot him in the back with a small calibre weapon, then sped away,” he added.

Lane’s girlfriend, Sarah Harper, posted a heartbreaking tribute to her boyfriend online, saying the four years she was with him were “the most amazing of my life.”

“I love you so much babe,” she wrote, adding “from 2009 until forever you will always be mine and a very special and protected place in my heart.”

Lane’s father also reacted to the senseless murder of his son.

“There’s not going to be any good come out of this because it was just so senseless,” he reportedly said.

All three teenagers are reportedly set to face first degree murder charges, which carry the potential of the death penalty.
